Agreement

By accessing or using Apragya (the 'Service'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Updates to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms and updating the 'Last Updated' date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

Eligibility

You must be at least 13 years of age to use Apragya. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet all eligibility requirements.

Account Responsibility

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. We are not liable for any loss resulting from unauthorised use of your account.

Acceptable Use

You agree not to use Apragya to: generate harmful, illegal, or abusive content; infringe third-party intellectual property; conduct phishing, fraud, or deception; distribute malware; scrape or harvest data without permission; or violate any applicable laws or regulations.

Fair Use

Free plan usage is subject to fair use limits. We reserve the right to throttle or suspend accounts that consume disproportionate resources or that appear to be automated beyond intended use.

Our IP

Apragya and all of its components, including but not limited to software, design, trademarks, and documentation, are owned by Apragya and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Your Content & Outputs

You retain ownership of the inputs (prompts) you submit and the outputs generated for you through the Service, subject to the licences granted below. You are responsible for ensuring your inputs do not infringe third-party rights.

Licence to Us

By submitting content to Apragya, you grant us a limited, non-exclusive, royalty-free licence to process, store, and display that content solely to provide the Service to you. We do not claim ownership of your content.

AI-Generated Outputs

Ownership of AI-generated outputs may vary by jurisdiction. You are solely responsible for how you use outputs and for ensuring their use complies with applicable law, third-party rights, and our Acceptable Use Policy.

Plans & Pricing

Apragya offers multiple subscription plans including Free, Starter, Pro, Business, and Enterprise tiers. Pricing details are available on our Pricing page and are subject to change. We will notify active subscribers of price changes at least 30 days in advance.

Billing Cycle

Paid subscriptions are billed in advance on a monthly or annual basis. Subscriptions automatically renew unless cancelled before the renewal date.

Refund Policy

We offer a 7-day money-back guarantee for new Pro subscriptions. After this period, payments are non-refundable except where required by law. Enterprise agreements follow the terms of the applicable order form.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access until then.

As-Is Basis

The Service is provided 'as is' and 'as available' without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated outputs will be accurate or complete.

AI Limitations

AI-generated content may be incorrect, biased, or outdated. You should independently verify any critical information before relying on it. Apragya is not liable for decisions made based on AI-generated outputs.

Cap on Liability

To the maximum extent permitted by law, Apragya's total liability to you for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.

Exclusions

In no event shall Apragya be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.

By You

You may stop using the Service at any time. You may delete your account from your account settings page, which will initiate our data deletion process.

By Us

We may suspend or terminate your access to the Service immediately, without prior notice, if you violate these Terms, engage in fraudulent or illegal activity, or for any other reason at our sole discretion. Paid plan refunds following termination for cause are not provided.

Governing Law

These Terms shall be governed by the laws of India, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising out of or relating to these Terms shall first be attempted to be resolved through informal negotiation. If unsuccessful, disputes shall be resolved through binding arbitration in Chennai, India, except that either party may seek injunctive relief in court for intellectual property infringement.
